Why SDLT Verification Matters More Than Ever
From 18 May 2026, conveyancing firms are required to register for HMRC's Agent Services if they pay SDLT to HMRC on behalf of their clients.
This requirement stems from the UK Finance Mortgage Lenders' Handbook, which requires conveyancers to hold all completion monies, including SDLT, before completion. It is the subsequent payment of those funds to HMRC that brings firms within the scope of Agent Services registration.
Whilst conveyancers are not expected to be tax specialists, registration with HMRC inevitably places greater focus on the firm's role in the SDLT process. As regulatory scrutiny increases, firms will need to demonstrate not only that the correct amount of tax has been paid, but also that they have appropriate procedures in place to evidence how that figure was arrived at.
A number of technology providers are introducing SDLT risk assessment tools to assist firms in identifying transactions that may require additional consideration. Whilst these can be useful, they do not remove the conveyancer's responsibility for deciding whether the information used to calculate the SDLT liability has been adequately verified or whether specialist tax advice should be obtained.
